Agreement to Terms

These Terms of Use (the “Terms”) govern your access to and use of CurrentBlack websites, communications products, digital fax services, and the CurrentBlack Marketplace SMS Relay Program (collectively, the “Services”). By creating an account, installing our applications, submitting the account setup form, or otherwise using the Services, you agree to be bound by these Terms.

Eligibility and Accounts

  • You must be legally able to form a binding contract in your jurisdiction.
  • You are responsible for the security of your account, devices, and credentials.
  • You must provide accurate information and keep it up to date.
  • You may only register or submit a phone number that you own, control, or are specifically authorized to register for this program.

CurrentBlack Marketplace SMS Relay Program

CurrentBlack offers a marketplace SMS relay program that allows a user to publish a CurrentBlack private number in a marketplace listing instead of publishing a personal number. When someone sends an SMS to that published CurrentBlack number, CurrentBlack may relay the message to the user’s verified personal number while keeping the personal number private.

The Marketplace SMS Relay Program is currently in pre-release account setup. Submission of the account setup form records the user’s email address, Terms acceptance, and related setup preferences, including whether the user separately enables optional SMS forwarding or optional operational SMS alerts to a personal number. It does not create an account, assign a number, guarantee activation, or obligate CurrentBlack to launch the program on any specific timeline or at all.

Program-Specific Conditions

  • Account setup for this program occurs through the public setup page at https://currentblack.web.app/sms-opt-in.html and applies only to this program.
  • SMS forwarding consent and operational SMS alert consent are each separate from Terms acceptance, unchecked by default, optional, and not required to create an account, purchase a number, or use the service.
  • Consent is specific to CurrentBlack’s marketplace relay use case and is not transferable to unrelated campaigns, third-party marketers, or other message programs.
  • Enabling optional SMS forwarding only authorizes listing-related and peer-to-peer relay messages to the registered personal number.
  • If a user separately enables optional operational SMS alerts, CurrentBlack may send account security, fraud, billing, or service interruption notices to the registered personal number. Operational SMS alerts do not include launch announcements, marketing, or promotional messages.
  • CurrentBlack sends account setup, launch access, product availability, and general service communications by email or in-app only unless a separate SMS setting expressly authorizes a specific operational notice category.
  • CurrentBlack may reject, suspend, limit, or discontinue relay activity or participation if we determine the use creates compliance, abuse, fraud, harassment, safety, or operational risk.

Acceptable Use

You agree not to misuse the Services. Prohibited activities include, without limitation:

  • Spam, unlawful robocalling, spoofing caller ID, harassment, or abusive behavior.
  • Infringing, illegal, or harmful content; malware; attempts to disrupt or degrade the network.
  • Using auto‑dialers, predictive dialers, or similar systems except where expressly allowed by law and these Terms.
  • Interfering with other users’ access or violating carrier policies or technical restrictions.
  • Using the Marketplace SMS Relay Program for marketing, lead generation, affiliate outreach, cold outreach, mass messaging, or any automated, high-volume, or non-conversational pattern.
  • Submitting someone else’s phone number to the account setup form without authority or attempting to obtain consent through deception.
  • Using the Services in connection with illegal listings, deceptive marketplace activity, fraud, impersonation, stalking, or unsafe/off-platform conduct.

We may suspend or terminate the Services for suspected violations, security risks, or to comply with legal or carrier requirements.

Service Limitations and No Emergency Use

  • The Services depend on third-party carriers, app stores, networks, infrastructure providers, and other systems outside CurrentBlack’s control. Delivery, routing, timing, and availability are not guaranteed.
  • Do not rely on the Services for emergency communications, 911 access, life-safety alerts, medical emergencies, legal deadlines, or other time-critical matters where failure, delay, or misrouting could cause harm.
  • Features described as pending, beta, preview, launching soon, or pre-launch may change, be delayed, or be discontinued without notice.

A2P Voice Compliance and Client Responsibilities

If you use the Services for A2P voice communications, you are solely responsible for compliance with all applicable telecom and privacy laws, regulations, and carrier rules. This typically includes, for example, the U.S. Telephone Consumer Protection Act (TCPA), Telemarketing Sales Rule (TSR), national and state Do‑Not‑Call (DNC) requirements, and any carrier program rules or local equivalents in your jurisdiction.

Registration, Consent, and Content

  • Complete all required brand/use‑case registrations and provide accurate sample scripts where required by carriers or regulators.
  • Obtain and document valid consent; maintain opt‑in/opt‑out mechanisms and honor revocations promptly.
  • Present truthful caller ID; no spoofing or misrepresentation.
  • Honor quiet‑hour restrictions and call frequency limits as required by law or carrier policy.
  • Scrub against applicable DNC lists and maintain suppression lists.
  • Retain compliance records (consents, scripts, campaign details, calling logs) as required.

Filtering, Audits, and Enforcement

  • Unregistered or non‑compliant traffic may be filtered, blocked, or throttled by carriers.
  • We may request proof of compliance and may suspend or terminate non‑compliant activity.
  • You are responsible for any regulatory, carrier, or third‑party claims arising from your A2P use.

Note: Some registration regimes (e.g., 10DLC) apply to messaging; analogous registration and content rules may apply to voice depending on jurisdiction and carrier. You are responsible for understanding and meeting the specific requirements applicable to your use.

P2P Voice — Personal Use Only

P2P voice is provided exclusively for genuine person‑to‑person, non‑commercial communications. Business use, marketing, lead generation, automated or mass calling, contact‑center operations, or any other commercial purpose is prohibited on P2P.

  • No auto‑dialers, predictive dialers, or prerecorded messages on P2P.
  • No bulk, sequential, or high‑volume patterns indicative of commercial activity.
  • Violation may breach applicable laws (e.g., TCPA/TSR in the U.S.) and carrier policies and may result in immediate suspension or termination.

Fax Use

You must ensure your fax use is lawful, respects privacy obligations, and does not transmit prohibited or harmful content. Do not send sensitive information unless legally permitted and with appropriate safeguards. We may limit storage or processing to protect users and comply with law.

Fees and Taxes

Paid Services, if any, may incur usage‑based fees, taxes, surcharges, carrier pass‑through charges, and third-party processing costs. We will disclose applicable pricing where relevant. You are responsible for all charges associated with your account and use.

Service Availability and Changes

We strive for high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features to maintain security, reliability, or compliance, or due to carrier/network constraints.

Changes to These Terms

We may update these Terms from time to time. We will post the updated version with a new effective date and provide additional notice for material changes where appropriate.
