Agreement to Terms
These Terms of Use (the “Terms”) govern your access to and use of CurrentBlack voice and fax services, including A2P (application‑to‑person) and P2P (person‑to‑person) voice functionality and digital faxing (the “Services”). By creating an account, installing our applications, or using the Services, you agree to be bound by these Terms.
Eligibility and Accounts
- You must be legally able to form a binding contract in your jurisdiction.
- You are responsible for the security of your account, devices, and credentials.
- You must provide accurate information and keep it up to date.
Acceptable Use
You agree not to misuse the Services. Prohibited activities include, without limitation:
- Spam, unlawful robocalling, spoofing caller ID, harassment, or abusive behavior.
- Infringing, illegal, or harmful content; malware; attempts to disrupt or degrade the network.
- Using auto‑dialers, predictive dialers, or similar systems except where expressly allowed by law and these Terms.
- Interfering with other users’ access or violating carrier policies or technical restrictions.
We may suspend or terminate the Services for suspected violations, security risks, or to comply with legal or carrier requirements.
A2P Voice Compliance and Client Responsibilities
If you use the Services for A2P voice communications, you are solely responsible for compliance with all applicable telecom and privacy laws, regulations, and carrier rules. This typically includes, for example, the U.S. Telephone Consumer Protection Act (TCPA), Telemarketing Sales Rule (TSR), national and state Do‑Not‑Call (DNC) requirements, and any carrier program rules or local equivalents in your jurisdiction.
Registration, Consent, and Content
- Complete all required brand/use‑case registrations and provide accurate sample scripts where required by carriers or regulators.
- Obtain and document valid consent; maintain opt‑in/opt‑out mechanisms and honor revocations promptly.
- Present truthful caller ID; no spoofing or misrepresentation.
- Honor quiet‑hour restrictions and call frequency limits as required by law or carrier policy.
- Scrub against applicable DNC lists and maintain suppression lists.
- Retain compliance records (consents, scripts, campaign details, calling logs) as required.
Filtering, Audits, and Enforcement
- Unregistered or non‑compliant traffic may be filtered, blocked, or throttled by carriers.
- We may request proof of compliance and may suspend or terminate non‑compliant activity.
- You are responsible for any regulatory, carrier, or third‑party claims arising from your A2P use.
Note: Some registration regimes (e.g., 10DLC) apply to messaging; analogous registration and content rules may apply to voice depending on jurisdiction and carrier. You are responsible for understanding and meeting the specific requirements applicable to your use.
P2P Voice — Personal Use Only
P2P voice is provided exclusively for genuine person‑to‑person, non‑commercial communications. Business use, marketing, lead generation, automated or mass calling, contact‑center operations, or any other commercial purpose is prohibited on P2P.
- No auto‑dialers, predictive dialers, or prerecorded messages on P2P.
- No bulk, sequential, or high‑volume patterns indicative of commercial activity.
- Violation may breach applicable laws (e.g., TCPA/TSR in the U.S.) and carrier policies and may result in immediate suspension or termination.
Fax Use
You must ensure your fax use is lawful, respects privacy obligations, and does not transmit prohibited or harmful content. Do not send sensitive information unless legally permitted and with appropriate safeguards. We may limit storage or processing to protect users and comply with law.
Fees and Taxes
Paid Services, if any, may incur usage‑based fees, taxes, surcharges, and carrier pass‑through charges. We will disclose applicable pricing where relevant. You are responsible for all charges associated with your account and use.
Service Availability and Changes
We strive for high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features to maintain security, reliability, or compliance, or due to carrier/network constraints.
Legal Terms
Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law.
Limitation of Liability
To the maximum extent permitted by law, CurrentBlack is not liable for indirect, incidental, consequential, special, or exemplary damages, or for lost profits, revenues, or data, arising out of or related to the Services.
Indemnification
You agree to defend, indemnify, and hold harmless CurrentBlack from claims, damages, liabilities, costs, and expenses arising from your use of the Services, your content, or your violation of these Terms or applicable laws (including A2P and P2P requirements).
Governing Law and Disputes
These Terms will be governed by the laws of the applicable jurisdiction designated by CurrentBlack (update this section with your governing law and venue). Disputes will be resolved in that venue, except where local law provides otherwise.
Changes to These Terms
We may update these Terms from time to time. We will post the updated version with a new effective date and provide additional notice for material changes where appropriate.
